On 12/12/2012, the Ministry of Science and Technology issued Circular No. 28/2012/TT-BKHCN provisions on disclosure standards, technical regulations and conformity assessment methods consistent with standards, technical regulations.
This Circular takes effect from January 27, 2013 and replaces Decision No. 24/2007/QĐ-BKHCN September 28, 2007 of the Minister of Science and Technology on the issuance of regulations certificate of conformity, conformity certification and announcement of standard conformity and announcement of the cases.
Law on Standards and Technical Regulations came into being as a breakthrough in the field of standards and technical regulations. It contributes to improve efficiency in the management process, to promote standardization activities in enterprises, enhance the competitiveness of products and goods, in accordance with the requirements of economic integration and special especially the requirements of the WTO when Vietnam officially a member of the WTO.
Law on Standards and Technical Regulations made clear view of the voluntary application of standards and mandatory for technical regulations. Standard system is divided into two levels, national and local level. Regulation system also consists of two levels, national and local level. Thereby avoiding duplication of process management and improve the self-responsibility of the business enterprise for its quality goods.
According to the Law on Standards and Technical Regulations and Decree 127/2007/ND-CP detailing a number of articles of the Law on Standards and Technical Regulations, the publication of applicable standards, published standards, conformity shall be as follows:
- Announcement of applicable standards is the responsibility of the organization or individual business notice of the standard number on their labels, or packaging, or in the other transaction documents.
- Announcement of the standard is a voluntary activity. Organizations and individuals announcement of standard conformity to the published registration at the Department of Standards and Quality in the locality where organizations and individuals registered business activities.
- Announcement of operation is required. The organizations and individuals to publish regulations to register the published cases specified in the corresponding specialized facility where local organizations and individuals registered manufacturing business activities.
Conformity procedures announced and published shall comply with the provisions of Decision 24/2007/QĐ-BKHCN issued on 28/9/2007 on the regulations conformity certification, conformity certification and publication of standard conformity announcement.
Thus the publication of quality standards of products, goods and public goods in line with standards, technical regulations, as it is no longer appropriate. The form of this switch to standard forms published and announced.
