Philippines requests additional compliance review in cigarettes dispute with Thailand

The Philippines has requested WTO dispute consultations with Thailand to address Thailand’s compliance with an earlier WTO ruling concerning Thai measures imposed on imports of cigarettes from the Philippines. The request was circulated to WTO members on 6 July.

This is the second request regarding implementation by Thailand of recommendations included in the original panel and Appellate Body reports in “Thailand – Customs and Fiscal Measures on Cigarettes from the Philippines” (DS371).  A compliance panel has already been established in regards to the measures cited by the Philippines in its first request.

When the parties disagree on whether the implementation of the recommendations and rulings has been carried out, a panel under Article 21.5 of the DSU can be established to rule on compliance.
