26/ Costa Rica launches safeguard investigation on white sugar

On 9 July 2019, Costa Rica notified the WTO’s Committee on Safeguards that it initiated a safeguard investigation on white sugar. As regards the timing of initiation, the notification states as follows.
(all translations on this page are provisional):
“An extract of the Resolution of Initiation was published in the Official Gazette La Gaceta No. 115 on 20 June 2019. Therefore, in accordance with the provisions of this resolution, the initiation of the investigation is 10 calendar days after publication in the Official Gazette.”
The notification further indicates, among other things, as follows:
“Any question about the procedure can be referred to Daniela Castro Murillo and Andrea Granados Soto of la Dirección de Defensa Comercial del MEIC via email (dcastro@meic.go.cr / agranados@meic.go.cr) or by telephone to the number (506) 2549-1400.”
“The parties will have 10 working days from the notification of the initiation of the investigation to present allegations and defense.
[…] A period of 8 business days, counted from the publication in the Official Gazette, is granted to anyone who considers himself or herself as an interested party in the process, so that he or she may appear before the Investigating Authority and demonstrate its direct interest and requirements to be considered as such.”

What is a safeguard investigation?
A safeguard investigation seeks to determine whether increased imports of a product are causing, or is threatening to cause, serious injury to a domestic industry.
During a safeguard investigation, importers, exporters and other interested parties may present evidence and views and respond to the presentations of other parties.
A WTO member may take a safeguard action (i.e. restrict imports of a product temporarily) only if the increased imports of the product are found to be causing, or threatening to cause, serious injury.
